The present petition under Article 226 of the Constitution of India seeks the following prayers: - "A. Issue a writ of Mandamus or any other appropriate Writ or order or directions for setting aside / quashing of the impugned order bearing no. NHB/09BLK/0CS/000200/2018-19/8556 dated 25.03.2019 rejecting the grant of the credit linked back ended subsidy of Rs. 120 lakhs by the respondent no. 2 for the construction of the cold storage project of the petitioner namely Apna Agro Cold Pvt. Ltd. sanctioned under the scheme of respondent no.2 namely "Capital Investment subsidy for construction / expansion / modernization of the cold storage and storage for horticulture produce" which is in complete contrast to the earlier decisions of the Respondent No. 2 releasing subsidy to promoters of cold storages where missing technical components were installed after a period of two years.

B. Issue a writ of mandamus or any other appropriate orders or directions to Respondent No. 2 to grant/release the credit linked back ended Subsidy of Rs. 120 lacs to the respondent no. 5 sanctioned to the petitioner for the construction of the cold store of the petitioner namely Apna Agro Cold Pet. Ltd. under the scheme of respondent no.2 namely "Capital Investment Subsidy for construction / expansion / modernization of the cold storage and storage for horticulture produce" at appropriate time of repayment of instalments of term loan of the petitioner. C. Pass any such further orders, as the Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interests of justice."

On the last date of hearing i.e., 23.07.2025, learned counsel for the petitioner had sought discharge as no instructions were received from the petitioner. Consequently, a Court notice was issued to the petitioner through all modes and report with regard to the same has come back served. However, none appears on behalf of the petitioner today. 4.

In these circumstances, the petition is dismissed in default for nonprosecution and disposed of. 5.
