This bail application has been filed under Section 438 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.') praying for grant of Anticipatory Bail in FIR no.0079/2023 registered with Police Station: Inderpuri, West, Delhi under Sections 6 & 17 of the Protection of Children from Sexual Offences Act, 2012 (in short 'POCSO').

This Court, by its interim order dated 24.05.2023, had directed that on the applicant joining investigation, as and when directed by the Investigating Officer (IO), in case the IO feels necessity of effecting arrest of the applicant, he shall be admitted to anticipatory bail till the next date of hearing on furnishing a personal bond of Rs.20,000/- and other conditions stipulated therein. This interim order was continued by the subsequent order dated 24.11.2023 of this Court.

Today, the learned APP for the State points out that the charge sheet has been filed, wherein the applicant has been placed in Column no.12.

confirmed. It is directed that in the event of arrest of the applicant in relation to the abovementioned FIR, he shall be admitted to anticipatory bail on furnishing a personal bond of Rs.20,000/- with one surety of the like amount to the satisfaction of the learned Trial, and further subject to the following conditions:

(i) the applicant will join investigation as and when directed, in writing;

(ii) the applicant shall not leave the National Capital Territory of Delhi without intimating the IO/SHO concerned;

(iii) the applicant shall not, directly or indirectly, try to contact/influence the complainant/victim or any other witness(s) or tamper with evidence of the case; and, (iv) the applicant shall furnish his mobile phone/landline number and residential address to the IO/SHO concerned and shall keep his mobile/landline phones operational at all times during this period, and in the event of any change of the same, will immediately inform the same to the IO/SHO.
