FAO(OS) 89/2019 The appellant, who is the defendant No.3 in CS(OS) No. 11/2017 has preferred the present appeal to assail the order passed by the learned Single Judge on 12.03.2019 in I.A No. 10337/2018. In the said application, the appellant/ defendant No.3 had sought the release of the amount which was claimed to be his share out of the amount of Rs. 7.5crores received from the sale of 50% of the property bearing No. A-12, Lawrence Road, Delhi. An

identical application had been moved by defendant No.4 i.e. I.A. No. 12634/2018. The learned Single Judge has rejected both the applications by the impugned order.

Defendant No.4 had assailed the impugned order by preferring FAO(OS) Nos. 84/2019, 85/2019 & 87/2019. In relation to the impugned order, including the order passed in I.A. No. 12634/2018, we had rejected the same vide our order dated 26.04.2019.

For the reasons stated in the said order, the present appeal is rejected. Dismissed.
