% 16.12.2024 CRL. M.A. 35643/2024 (under Section 530 BNSS 2023 filed by appellant no. 2 (Santosh Kumar Jasrasaria) seeking permission to travel abroad) 1.

The present application has been filed under Section 530 of BNSS 2023 by the appellant no. 2/applicant (Santosh Kumar Jasrasaria) seeking permission to travel aboard for personal and professional purposes from 15.12.2024 to 31.01.2026.

Learned counsel appearing on behalf of the petitioner submits that appellant/applicant has already been granted similar permission by this Court vide various orders which have been annexed to the present application. 3.

passed in Crl. M.A. 8177/2024 whereby the appellant no. 2/applicant was granted permission to travel abroad from 15.05.2024 to 31.07.2024. 4.

In view of the above, issue notice. Learned Special PP appearing on behalf of CBI/respondent accepts notice and submits that the permission is being sought for longer period. He submits that this Court may consider granting permission to travel abroad only for a short duration. 5.

The attention of the Court has also been invited to order dated 26.07.2021 by the learned counsel for the petitioner to contend that the entire dues of the bank have been repaid by the appellant no.2/applicant under one time settlement in November, 2012. This position is not disputed by the learned Special PP appearing on behalf of CBI/respondent. 6.

In view of the above and having regard to the previous orders granting permission to the appellant no. 2/applicant to travel abroad and considering the observations made by this Court in order dated 26.07.2021, the petitioner is granted permission to travel abroad from 20.12.2024 till 30.06.2025 as per the itinerary that shall be furnished to the IO. The permission shall be subject to the following terms and conditions:

i. He shall file an affidavit giving a detailed itinerary to the Investigating Officer;

ii. He shall furnish security to the tune of Rs.5,00,000/- in the form of an FDR in favour of the Registrar General of this Court; iii. He shall inform the IO regarding his return one week prior to his return to India; and iv. He shall have no objection if the present appeal is taken up for hearing in his absence and assures that his counsel will remain present to argue the matter.
