% 29.04.2019 After some hearing, learned counsel for the petitioner seeks permission to withdraw the writ petition and seeks liberty to approach the Appellate Forum in accordance with law.
This court notices that the appeal against the impugned order is maintainable under Section 246(1)(j) of the Income Tax Act. The impugned order was passed on 29.03.2019. In case the petitioner approaches the Commissioner (Appeals) within two weeks, the appeal shall be heard and decided on merits and not rejected on the ground of limitation.
The writ petition is dismissed as withdrawn with liberty as aforesaid.
