This revision petition has been filed challenging the dismissal of CRL.A. no. 278/2018 by ASJ: Special Judge (NDPS), West District, Tis Hazari Courts, Delhi [the Appellate Court] wherein appeal was filed challenging the impugned judgment of conviction dated 5th September, 2018 and order on sentence dated 20th November, 2018 by MM-03, West District, Tis Hazari Courts, Delhi.

Petitioner was convicted for offence punishable under Section 324 of IPC and sentence to one year rigorous imprisonment and a fine of Rs.5,000/- .

Counsel for the petitioner states that Rs.5,000/- has been deposited and the petitioner has already undergone custody for about 9 months and 7 days.

Mr. Anuj Aggarwal, counsel for the petitioner pleads on instruction that the petitioner's sentence be reduced to the period already undergone and he is ready to accept the conviction.

Case of the prosecution was relating to an incident dated 27th September, 2011, at the complaint of one Harjeet Singh, who stated that he came out of his house and the petitioner started shouting and abusing him, and when his wife Suman came out, the petitioner assaulted his wife on the right shoulder with the knife. As per the MLC exhibit A-1 the injury has been opined as simple.

The petitioner was, however, convicted and sentenced. 7.

Considering the plea of the petitioner, the Court considers it fit to reduce the sentence of the petitioner to the period already undergone. Petitioner has already been released from jail on 31st May, 2019 by order of this Court dated 24th May, 2019.

Accordingly, the revision petition is disposed of with the aforesaid directions.
