By this petition, petitioner seeks anticipatory bail in case FIR No. 126/2017 under Sections 308/323/34 IPC registered at PS Hauz Qazi, Delhi on the complaint of one Shiv Kumar.

On 8th October, 2017 two PCR calls were received at PS Hauz Quazi recorded vide DD Nos. 12A and 14A respectively. On reaching the spot, ASI Rajesh Kumar found that a quarrel had taken place between the two groups and members of each group were pelting bricks and stones on each other. Five persons including the complainant Shiv Kumar were injured from the side of the complainant whereas eight persons from the side of the petitioner were injured. Injuries to four persons from the side of complainant, that is, Narender, Shshank, Vicky and Shiv Kumar have been opined to be simple in nature and injury to the fifth victim Sangeeta has BAIL APPLN. 226/2018

been opined to be grievous in nature. The reason for quarrel was on the distribution of amount of donation of Jagran on account of which initially verbal exchange of words took place at 10.00 AM however, at 11.40 AM when Shiv Kumar was allegedly sitting at a Chabutra, Ramu and Gangu who were residents of Katra came to him and started quarrelling. It is thereafter that the entire brawl took place between the two parties. 3.

Considering the nature of allegations and that injuries have been received by members of both sides, this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned further subject to the condition that he will join the investigation as and when directed by the Investigating Officer, further subject to the condition that in case of change of residential address the same will be intimated to the court concerned by way of an affidavit. 4.

Petition is disposed of.
