The petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 8CrPC9) has been filed on behalf of the Petitioner for quashing of FIR No. 305/2020 under Sections 420/406/120B of the Indian Penal Code, 1860 (hereinafter referred to as 8IPC9) registered at P.S. Fatehpur Beri. 2.

The Petitioner had initially arrived at a settlement vide MoU dated 10.08.2020 by which a total sum of Rs.42,51,000/- was to be paid to the Complainant/Respondent No. 2. However, certain other disputes arose and eventually, the final settlement has been arrived at between the Petitioner, Respondent No. 4 and Respondent No.2/Complainant vide settlement dated 25.04.2025, whereby the Petitioner have agreed to pay an additional draft in the sum of Rs.2 lakhs to the Complainant.

Likewise, Respondent No. 4/Amit Sharma who is present in Court had also agreed to pay a sum of Rs.2 lakh to the Respondent No. 2. In all, Rs.4 lakhs have to be paid by the accused/Petitioner and Respondent No. 4 to the Complainant. The two Drafts i.e. one drawn on Axis Bank, Civil Lines, Delhi bearing No. 006746 dated 29.04.2025 for a sum of Rs.2 lakhs and another drawn on HDFC Bank bearing No. 011495 dated 30.04.2025 for a sum of Rs.2 lakhs favouring Respondent No.2/Rahul Nath are handed over today in Court to the Respondent No. 2, who has received the same. 5.

The Petitioner is represented through his father who is present in Court. Respondent No. 2/Complainant and Respondent No. 4/accused are present in person.

The parties have endorsed the terms of settlement and state that they have arrived at the said settlement without any pressure and coercion and shall remain bound by the terms of settlement. The complainant has stated that the FIR against all the accused may be quashed, on account of settlement.

commission from the Complainant in advance, but subsequently, the accused persons failed to arrange the funds for the Complainant. On these allegations, the FIR No. 305/2020 under Sections 420/406/120B IPC was got registered at P.S. Fatehpur Beri.

Considering the nature of allegations and the fact that the parties have amicably resolved all their disputes, no fruitful purpose will be served in continuing with the FIR and the proceedings emanating therefrom. Accordingly, FIR No. 305/2020 under Sections 420/406/120B IPC registered at P.S. Fatehpur Beri and the consequent proceedings are hereby quashed.

The Petitions are disposed of accordingly. Pending Applications, if any, also stand disposed of.
