The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.1214/2015 registered under Section 376 IPC at PS Punjabi Bagh. Status report is on record.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. It is informed by the complainant that the matter has been settled between the parties and they have agreed to file petition for divorce by mutual consent. The complainant has no objection to the grant of bail. It is informed that `15 lacs are to be paid to the complainant in full and final settlement of all the disputes.

The FIR was lodged on the directions of the learned Metropolitan Magistrate under Section 156(3) Cr.P.C. under Sections 376/495 IPC on 23.11.2015. In her complaint, the complainant stated that she worked in the beauty-parlour of the petitioner from 2007 to 2010. She was divorcee at that time. During her presence at the beauty-parlour, the petitioner contacted her to marry. She and the petitioner married in 2007 and a male child was born out of this wedlock in 2010. Subsequently, she came to know that the petitioner was already married.

Since the parties have settled the dispute and have opted to get divorce by mutual consent pursuant to the settlement arrived at between them and the complainant has no objection to the grant of bail, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
