% 29.08.2018 Learned counsel for plaintiff requests for his discharge in this matter.
It is submitted by learned counsel for plaintiff that he has already served notice upon his client but none turned up. It is further submitted that he has sent Whatsapp message in this respect to his client but they failed to contact him.
Perusal of record shows that vide order dt.22.3.18 LRs of deceased plaintiff were substituted subject to payment of cost of Rs.25,000/- within two weeks with condition that if costs is not paid the suit shall be deemed to have been dismissed as abated. On query, it is submitted by learned counsel for plaintiff that since client has failed to contact him, hence, aforesaid cost has not been paid.
In the aforesaid circumstances there is nothing to proceed further in this matter.
This suit stands abated in terms of order dt.22.3.18 passed by Hon'ble Court.
Tomorrow's date stands cancelled.
