O R D E R

Learned counsels for the parties have drawn the attention of this Court to the order dated 13th February, 2024 passed by the Division Bench of this Court in LPA 453/2023.

By the said order, learned Division Bench has recorded the settlement th arrived at between the parties and has held that the judgment dated 28 March, 2023 passed in W.P.(C) 7409/2007, will no longer be enforceable. th 3.
The order dated 13 February, 2024 passed in LPA 453/2023 reads as under:
"1. The present appeal under Clause X of the Letters Patent seeks to assail the order dated 28.03.2023 passed by the learned Single Judge in W.P.(C)7409/2007. Vide the impugned order, the learned Single Judge has rejected the appellant's challenge to the award dated 19.07.2007 passed by the learned Industrial Tribunal.

of the present appeal, the parties have arrived at an amicable settlement before the Delhi High Court Mediation and Conciliation Centre on 12.02.2024, according to which the appellant has agreed to pay a sum of Rs.19.50 lakhs to the respondent in full and final settlement of all his dues under the award dated 19.07.2007 as also the impugned judgment dated 28.03.2023.
3. Learned counsel for the appellant hands over in Court a Demand Draft dated 12.02.2024 bearing No.830896 of Rs.19.50 lakhs in favour of the respondent to his counsel.
4. In the light of the aforesaid, once the parties have themselves arrived at an amicable settlement, the appeal is disposed of in terms of the settlement arrived at between them by making it clear that the respondent will no longer have any surviving claim against the appellant. Consequently, the impugned order and the judgment will no longer be enforceable.
5. The appeal stands disposed of."

In view thereof, no further orders can be passed in the present proceedings. Accordingly, the present petition is disposed of, as having been satisfied.
