A Petition under Section 528 BNSS has been filed on behalf of the Petitioner Yasin @ Gilli for grant of custody parole to attend the burial of his mother Smt. Badroon Nisha @ Badroon who died on 11.04.2025 at Hindu Rao Hospital, Gandhi Square, Malka Ganj, Delhi at 12:45 P.M and her burial is scheduled to be held today at Qabristan Anjuman Quam E Raiyan, Old Sabzi Mandi, Malka Ganj, Delhi.

It is submitted that the Petitioner is an accused in case FIR No.195/2017 under Section 302/201/120-B/34 IPC. It is further submitted that the other two co-accused having similar role have been granted Regular The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Bail. The Petitioner was granted Interim Bail in 2020, the conditions of which were not flouted and he surrendered on time. Therefore, custody parole is sought for attending the burial.

Learned APP for State submits that a Police Official is present at Hindu Rao Hospital, where the body of the deceased has not been released. The time of burial is not known and, therefore, without verification the custody parole may not be granted.

Submissions heard and record perused.

The custody parole for today has been sought by the Petitioner only to attend the burial of the mother at Qabristan, Malka Ganj. Considering the exigencies, it is hereby directed that Petitioner is granted custody parole to attend the burial for maximum of six hours excluding travel time, considering that the burial time is yet to be fixed. 8.
It is further directed that the Petitioner be taken in custody to his residence first and thereafter, to Qabristan Anjuman Quam E Raiyan, Old Sabzi Mandi, Malka Ganj, Delhi, for the burial and thereafter, be brought straight back to the concerned Jail.

The Petition is accordingly disposed of.

Copy of the Order be sent to the concerned Jail Superintendent for information and necessary compliance.

Copy of the Order be given DASTI under the signatures of Court Master to both the parties.
