O R D E R

% 17.01.2025 By way of the present petition filed under section 438 of the Code of Criminal Procedure 1973 ('Cr.P.C.'), the petitioner seeks anticipatory bail in case FIR No. 0100/2024 dated 17.02.2024 registered under sections 376/328/506 of the Indian Penal Code, 1860 at P.S.: Burari, Delhi.

Notice on this petition was issued on 16.04.2024; pursuant to which Status Report dated 15.01.2025 has been filed of behalf of the State. 3.

Mr. Saurabh Agarwal, learned counsel appearing for the petitioner submits, that subject to the petitioner joining investigation, he was granted interim protection vide order dated 16.04.2024 passed in the present proceedings.

Learned counsel accordingly prays, that the present petition may be disposed-of by allowing the anticipatory bail plea. 6.

Mr. Utkarsh, learned APP appearing on behalf of the State confirms the submissions made as above; and leaves it to the court to pass appropriate orders.

In view of the facts and circumstances of the case, especially the fact that trial in the matter is about to be concluded, this court is inclined to allow the present petition for anticipatory bail, thereby directing that in the event of his arrest, the petitioner - Rahul s/o Chandpal Singh - shall be admitted to bail by the Investigating Officer/Arresting Officer subject to the following conditions : 7.1.

The petitioner shall furnish a personal bond in the sum of Rs.25,000/- (Rs. Twenty-five Thousand Only) with 02 sureties in the like amount from the family members to the satisfaction of the Investigating Officer/Arresting Officer; 7.2.

The petitioner shall furnish to the Investigating Officer a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

7.3.

If the petitioner has a passport, he shall surrender the same to the learned trial court and shall not travel out of the country without the prior permission of the learned trial court; 7.4.
