% 08.05.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks transfer to an open jail. Mr. Sanjeev Bhandari, learned ASC for the State submits, that the representation to the jail authorities in the present case has been filed by an advocate and not by the petitioner herself. He submits, that this practice would not amount to a valid representation to the jail authorities. This court is of the view that, among other reasons, a representation made by way of an e-mail under the hand of an advocate may lead to complications inasmuch as in a given case the prisoner may not own up or acknowledge to the contents of such a representation. In the circumstances, the present petition is disposed-of, granting the petitioner a liberty to file an appropriate representation under her own hand, which may be considered in accordance with law. Pending applications, if any, disposed-of.
