% 24.07.2020 The hearing was conducted through video conferencing.
1. The petitioner is aggrieved by the issuance of a sealing notice dated 29.06.2020 by the respondent Corporation. This writ petition has been preferred because the statutory forum viz. the learned ATMCD, is currently non-functional.
2. However, the learned counsel for North Delhi Municipal Corporation ('NDMC'), submits that the said Tribunal has resumed functioning as of the last two days, for hearing of urgent matters, and according to her the petitioner's case would qualify as an urgent one.
3. The petitioner seeks relief apropos the 3rd and 4th floor of property bearing no. 359, Dr. Mukherjee Nagar, Delhi - 110 009.
According to the Corporation, the third floor has been sealed and demolition action apropos the 4th floor has already been taken.
4. In view of the above, the learned counsel for the petitioner seeks to withdraw the petition with liberty to approach the learned ATMCD for appropriate relief.
5. Accordingly, the writ petition, alongwith pending application, is dismissed as withdrawn. Liberty granted.
