% 07.02.2019 O.M.P. (Comm.) 74/2018 As per office note, process to respondent no.2 is still awaited. At this stage, Mr. Abhishek Roy, learned counsel for respondent no.3 submits that he is appearing for respondent no.3 only and not for respondent no.1. It is further submitted that respondent no.1 was duly served as the service was effected on respondent no.1 on the address of respondent no.3.

Per contra learned counsel for petitioner submits that respondent no.1 has been duly served. Learned counsel submits that respondent no.1 had shown the address on which it was served as its own address but is unable to point out any documents at this stage due to paucity of time. Without prejudice to the rights of the petitioner to contend due service of respondent no.1, at request, issue fresh notice to respondent no.1&2 through all permissible modes including electronic mode and dasti, returnable for 14.02.2019.
