The present application has been filed jointly by the parties under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 [CPC], seeking the disposal of the suit in terms of the Settlement arrived at between the parties. 2.

The application is duly signed by the counsel and supported by their affidavits.

Mr. Jagjit Singh Taneja and Mr. Jagdish Kukreja have joined the proceedings through video conferencing link and are duly identified by their counsel.

In view thereof, Mr. Jagjit Singh Taneja is impleaded as proprietor of defendant no.1 on the oral request of the parties. The plaintiff is directed to place on record the amended memo of parties within one [1] week. 6.

Ms. Shreya Gagneja, Advocate, enters appearance on behalf of the defendants. She states she has filed her Vakalatnama during the course of the day.

Learned counsel for the parties state that the plaintiff and the defendants decided to settle their dispute amicably and to avoid any further litigation. They state that the parties agree to remain bound by the terms of the settlement.

They state that the terms of the settlement are more specifically recorded in paragraph '2' of the captioned application. 8.

This Court has perused the terms and conditions of the settlement agreement and is satisfied that the compromise between the parties as contained in the captioned application satisfies the requirement of the Order XXIII Rule 3 CPC. The compromise contained in the captioned application is lawful, and therefore, this Court does not find any impediment in disposing of the underlying suit in terms of the aforenoted settlement. 9.

The statement and undertakings given by the learned counsel for the parties are accepted by this Court, and the parties are held bound by the same.
