W.P.(C) 905/2018 and CM No. 3823/2018 (for stay) The present petition has been filed by the petitioner challenging the order dated January 25, 2018. After hearing the counsel for the petitioner, I do not see any merit in the challenge to the said order, which is a detail and a speaking order after considering the relevant facts and the submissions made by the petitioner.
At this stage, Mr. Sachin Mittal, learned counsel appearing for the petitioner states, the petitioner will comply with the three directions given by the authority at Pages 138 and 139 of the petition. His only submission is
that in so far as direction no.1 is concerned, he will give a formal application with requisite documents for de-sealing of Shop No 408 to the Deputy Health Officer, Rohini Zone, Delhi by tomorrow evening and the said application may be considered by the respondent at the earliest. Ms. Mini Pushkarna, learned Standing Counsel learned counsel appearing for the respondent / North Delhi Municipal Corporation on instructions from Mr. Sohan Lal Tanwar, PHI, Rohini Zone, North Delhi Municipal Corporation states, if such an application is received from the petitioner by tomorrow evening, same shall be considered and appropriate order shall be passed within a week thereafter. The said statement is taken on record.
With the aforesaid observations, the petition and the connected application are dismissed.
