% 08.03.2025 Appellant insurance company has filed an appeal for reduction of the award dated 04.03.2023 passed by the Learned MACT, awarding a compensation of Rs. 79,27,000/- along with interest @ 7% p.a. from the date of filing of claim petition. On appeal, the insurance company deposited 70% awarded principal amount along with accrued interest in term of the order dated 24.05.2023 passed by this Hon'ble Court and the direction was issued for release to the claimant as per the scheme of disbursal contained in the award. Ld. Counsel for the respondent no. 1 submits that the insurance company has deposited Rs.79,03,914/- (inclusive 70% awarded principal amount along with interest @7% p.a. till the date of deposit in The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. We have interacted with the learned Counsel/parties concerned. Apropos such interaction and due deliberation, it is agreed between the parties that respondent No. 1 shall get lump- sum amount of Rs. 35,00,000/- over and above the deposited amount as full and final compensation.
In view of the above, appellant-insurance company is directed to deposit Rs. 35,00,000/- before the concerned Tribunal within a period of six weeks from today failing which the appellant shall pay interest @7% p.a. on the delayed deposit. The said amount be directed to be released to the respondent No. 1 subject to fulfilment of all the requisite formalities.
The statutory amount deposited as a pre-condition for filing appeal with interest, if any, be refunded to the Insurance Company. The present appeal alongwith the pending application(s), if any, is disposed of with directions in terms of the foregoing settlement. A copy of this order be sent to concerned Ld. Tribunal with LCR, if requisitioned and received.
