This is a joint application filed on behalf of the parties under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 for recoding of compromise arrived at between the parties.

The application has been duly signed by the authorised signatories of the parties as well as their respective counsels. 3.
The terms of the settlement are recorded in paragraph no.2 of the application.

I have gone through the terms of the settlement and find the same to be lawful.

The parties shall remain bound by the terms of the settlement. 6.
A decree of permanent injunction in terms of prayer clause 78 (a) of the plaint is passed in favour of the plaintiff and against the defendants. 7.
The plaintiff does not wish to press for the remaining reliefs prayed for in the plaint.

In view of the above, the suit is decreed in terms of the settlement. 9.
Decree sheet be drawn up accordingly. The present application shall form a part of the decree.
10.
Since the matter has been settled at an initial stage, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff, in terms of Section 16 of the Court Fees Act, 1870. 11.
All pending applications stand disposed of.
