Mr. Narula, learned counsel for the respondents states on instructions that on the date the petitioner had submitted his representation, i.e., on 15.01.2018, there was no regular vacancy on the post of Inspector (Ministerial) in the NDRF. However, the situation has changed thereafter. He submits that as the petitioner's representation has not reached the competent authority so far, a decision has not been taken thereon. He assures the Court that the said representation shall be considered in the light of the changed circumstances.

To cut short the delay, Ms. Lamba, learned counsel for the petitioner has furnished a copy of the representation dated 15.01.2018 submitted by the petitioner to the DG, BSF, to learned counsel for the respondents.

The said representation shall be considered by the competent authority and an W.P.(C) 813/2018

appropriate order passed in accordance with law, keeping in mind the vacancy position on the post of Inspector (Ministerial) in the NDRF. The decision taken shall be communicated to the petitioner within two weeks from today.

In the event, the respondents reject the representation of the petitioner, he shall be entitled to seek legal recourse as may be available to him. 4.

The petition is disposed of with the aforesaid directions. 5.

Till an appropriate order is passed on the petitioner's representation dated 15.01.2018, the parties shall maintain status quo. DASTI to the counsels for the parties.
