The present petition has been filed by the Petitioner-M/s. Raipur Expressways Ltd. under Section 29A of the Arbitration and Conciliation Act, 1996, seeking an extension of the mandate of the three member Arbitral Tribunal.

The Petitioner, part of a consortium led by Ms. Apollo Enterprises Limited from the Isle of Man, was awarded a project for upgrading a section of National Highway - 6 in Chhattisgarh to a 4-lane divided highway on a Build, Operate and Transfer (hereinafter, 'BOT') basis. Following the award of the project, a Concession Agreement was executed in October 2005, with a scheduled completion date in October 2008. Thereafter, disputes arose during the execution of the contract, leading to failed conciliatory efforts and the eventual invocation of arbitral proceedings in 2018. The ld. Tribunal was formed in January 2019. The mandate of the ld. Arbitral Tribunal expired on 3rd April, 2024. Hence, the present petition. 4.

Today, it is stated that the matter is at the stage of final arguments before the ld. Arbitral Tribunal. Further, both the parties consent to the extension of the mandate of the ld. Arbitral Tribunal. 5.

Accordingly, the mandate of the ld. Arbitral Tribunal is extended till 31st December, 2024.
