The learned counsel for the applicant draws this Court's attention to the medical status report of applicant received from the Jail Superintendent and states that medical condition of the applicant herein is serious. states that the regular bail application was also not considered as yet on merit by the learned Trial Court. In these circumstances without prejudice to his rights and contentions, he seeks permission to withdraw the present application with liberty to move appropriate application for interim bail as well as regular bail before the learned Trial Courts. 6.
It is clarified that the factum of this application being withdrawn by the learned counsel for accused will not come in the way of the application for bail, regular or interim being considered on merit by the learned Trial Court.

Accordingly, the present bail application stands dismissed as withdrawn.
