O R D E R

The present bail application has been filed on behalf of the petitioner seeking interim bail in FIR No. 271/2016 registered under Sections 302/307/34 IPC at Police Station Pandav Nagar, Delhi on the ground that the co-accused have already been released on interim bail. 2.

Learned counsel for the petitioner submits that although the previous application seeking interim bail filed by the petitioner was dismissed on 15.06.2020, however, thereafter the other co-accused have been released on interim bail. She submits that the petitioner is aged about 65 years and has been in custody for more than 4 years. She further submits that the role assigned to the present petitioner is of only catching hold.

Learned APP for the State, on the other hand, has opposed the bail application. However, on instructions, she submits that after dismissal of the earlier interim bail application, co-accused have been released on interim bail and that the petitioner is not found involved in any other case. 4.

Keeping in view the facts and circumstances of the case, the petitioner is admitted to interim bail till 31.08.2020, on his furnishing a personal bond in the sum of 25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/Duty MM and subject to the following conditions :- (i) The petitioner shall not leave the jurisdiction of NCT of Delhi.

(ii) The petitioner shall remain available on his mobile number i.e. 8178988737, which he undertakes to keep operational during the period of his interim bail. (iii) The petitioner shall further remain in touch telephonically with Inspector D.K. Tejwan, P.S. Pandav Nagar on mobile number: 8750870689 on every Monday and Friday during the period of his interim bail.

(iv) The petitioner shall not get in touch with the prosecution witnesses directly or indirectly and shall not make any effort to tamper with the evidence.

(v) The petitioner shall surrender at the expiry of his interim bail before the concerned Jail Superintendent.

With the above directions, the bail application is disposed of. 6.

A copy of this order be communicated to the concerned Jail Superintendent electronically.
