This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

"(i) Issue an Appropriate Writ, order or directions thereby directing the respondent to handover the Possession of Flat No. 347, Third Floor, Pocket-A14 of Kalkaji, New Delhi measuring 25 Sq. Mtrs to the Petitioner without insisting for the 'No Trace Certificate' of Petitioner's wife;

(ii) Award costs of the present writ petition in favour of the Petitioner and against the respondents; and"

The case of the petitioner is that allotment of the flat No. 347, Third Floor, Pocket-A14 of Kalkaji, New Delhi was made in the joint names of the petitioner and his wife Ms. Rekha Das.

December, 2005 and the whereabouts of Ms. Rekha Das are not known since then.

The petitioner in the present petition seeks change in the allotment from joint names to the name of the petitioner alone. 5.

Ms. Gupta, learned counsel for the respondent, has handed over an amended Allotment Letter dated 04.10.2024, wherein Flat No. 347, Third Floor, Pocket-A14 of Kalkaji, New Delhi has been issued in favour of the petitioner and the petitioner has also taken possession in terms of the possession register.

For the said reasons, the relief sought by the petitioner has been presumably granted.

There is nobody is appearing on behalf of the petitioner. 8.

In view of the documents handed over in Court today, namely amended Allotment Letter dated 04.10.2024 and extract from Possession Register, the petition is disposed of.
