IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CONT.CAS(C) 367/2019 & CM No. 20163/2019 SACHIN TANEJA ..... Petitioner Through:

Mr Prosenjeet Banerjee, Advocate.

versus SONALI NATH ..... Respondent Through:

Mr Anshul Duggal and Mr Sahil Modi, Advocates for R-4.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 30.04.2019 1.

The petitioner has filed the present petition, inter alia, praying that action be taken against the respondent for wilful and deliberate disobedience of the order dated 15.12.2016 passed in W.P.(C) 10866/2016, whereby the respondent was restrained from changing the surname name of the children of the petitioner and the respondent in various records. 2.

It is alleged by the petitioner that the said order has been violated, inasmuch as the respondent has changed the surname of their two children from 'Taneja' to 'Nath', in various records.

3.

The writ petition - W.P (C) 10866/2016 - has been disposed of today leaving it open for the effected children to take necessary remedies if they are aggrieved by the change of name. It is noticed that one of the children of the petitioner has already attained the age of majority and the other child is aged 17 years. Both the children are not of an age where they cannot make

decisions on their own, with regard to their surname. 4.

Since, none of the children have voiced any grievance, this Court does not consider it apposite to examine the controversy any further. The same is disposed of. The pending application is also disposed of. VIBHU BAKHRU, J APRIL 30, 2019 MK
