By way of the present petition, the petitioners seek quashing of FIR No. 0041/2024, registered at Police Station Anand Vihar, Delhi, for the commission of offences punishable under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the "IPC"), and all consequential proceedings emanating therefrom, on the basis of Mediation Settlement dated 28.02.2025 arrived at between the parties. Issue notice. The learned APP accepts notice on behalf of the State. 5.

The brief facts of the case are that the marriage between Petitioner no. 1 and Respondent no. 2 was solemnized on 15.04.2014 according to Hindu rites and ceremonies. Thereafter, Respondent no. 2 lodged a complaint dated 12.04.2023 against the Petitioners alleging harassment and torture, pursuant to which the above-mentioned FIR came to be registered against the petitioners. Respondent no. 2 had also filed a maintenance petition before the learned Family Court, Rohini Courts, Delhi and a complaint under Section 12 of the Protection of Women from Domestic Violence Act, 2005 before the learned J.M.F.C. Mahila Court, Shahdara District, Karkardooma Courts, Delhi. During the proceedings before the learned Mahila Court, the parties amicably resolved their disputes vide mediation settlement dated 28.02.2025.

On a query being put by this Court, Respondent no. 2 has categorically stated that she has entered into the compromise out of her own free will and without any pressure, coercion or threat. It is also stated that the parties have been living together. Therefore, she has no objection if the present FIR is quashed.

In view of the above, and considering that the parties have amicably resolved their disputes out of their own free will and without any coercion, no useful purpose would be served by continuing the present proceedings, and the same would only result in further acrimony between them. Therefore, it would be in the interest of justice to quash the FIR in question and all proceedings emanating therefrom. There is no legal impediment in quashing the present FIR.

Accordingly, FIR No. 0041/2024 registered at Police Station Anand The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Vihar, Delhi, for the commission of offences punishable under Sections 498A/406/34 of IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
