STATE, NCT OF DELHI .....Respondent Through:

Mr. M.S.Oberoi, Additional Public Prosecutor

CORAM:

HON'BLE MR. JUSTICE SUNIL GAUR

O R D E R

% 30.04.2019 Petitioner seeks pre-arrest bail in FIR No.911/2015, under Sections 420 IPC, registered at police station Jamia Nagar, Delhi while claiming to be innocent.

Learned counsel for petitioner submits that there is delay of twenty days in lodging the FIR and now after four years petitioner is sought to be arrested and that petitioner has already joined the investigation and therefore, petitioner deserves pre- arrest bail. Learned Additional Public Prosecutor opposes this application and has produced copy of the minutes of the Investigating Committee of 15th June, 2015 which is accompanied by petitioner's resignation letter, in which petitioner had admitted that he had sold question papers in question to someone for a consideration of ₹10,00,000/-. BAIL APPLN. 1081/2019

Upon hearing and on perusal of material on record, minutes of the Investigating Committee proceedings and petitioner's resignation letter, I find that the gravity of offence committed by petitioner, disentitles him to seek pre-arrest bail.

Accordingly, the applications are dismissed while refraining to comment upon the merit of the case.
