The present application under Section 483 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Section 439 read with Section 482 of the Code of Criminal Procedure, 1973 seeking interim bail of 30 days in FIR No.230/2022 registered for offences under Sections 302/34 of the IPC, 1860 and Section 27 of the Arms Act, 1959 registered at police station Sangam Vihar.

The date of arrest in connection with the aforesaid FIR is 08.11.2022. The investigation is completed and the supplementary chargesheet was also filed. The trial is at the stage of prosecution evidence and it appears that six out of 47 witnesses have already been examined. The applicant's regular bail was dismissed by the trial Court on 05.11.2025 and 26.02.2026. The applicant by way of the instant application, submits that the petitioner be released for a period of 30 days to maintain social ties. The petitioner's wife has filed a divorce petition due to his continuous incarceration. He submits that the petitioner has already undergone approximately four years of imprisonment.

The Court has considered the submissions made by the applicant and also finds that in Criminal Appeal No.1054/2019, the Division Bench vide order dated 01.04.2026 has granted interim bail for a period of 30 days for the stated reasons. In the said appeal, the applicant has challenged the conviction and sentence awarded by the trial court in connection with FIR 433/2018 for offences under Section 302/506 IPC at Police Station Samaypur Badli.

The Court thus finds that for the same reasons as recorded in the order dated 01.04.2026 by the Division Bench, the applicant can be granted interim bail for a period of 30 days from the date of release. Ordered accordingly.

The terms and conditions shall be similar as has contained in the order dated 01.04.2026 passed by the Division Bench. 7.
Application stands disposed of.
