Vide the present petition, the petitioner had sought a direction to the respondent no.1 to demolish the unauthorised constructions on the property bearing no.3482, Gali Kartar Singh, Arya Pura, Subzi Mandi, Delhi, which was stated to have been carried out by the respondent no.2 2.
Learned counsel for the respondent no.1 states that though the respondent no.1 had issued a demolition notice to the respondent no.2 and had fixed the demolition programme for 12.12.2018 but it was found that the respondent no.2 had himself demolished certain pillars on first and second floors of the property. He further submits that even otherwise the respondent no.2 had already submitted an application for regularisation of unauthorised construction on
22.03.2018, which was not being considered due to certain deviations which now the respondent no.2 claims to have removed and has therefore approached the respondent no.1 on 28.12.2018 for reopening of his regularisation application dated 22.03.2018. He further states that the aforesaid application of the respondent no.2 is now being re-considered by the respondent no.1. 3.
None appears for the petitioner despite passover, it appears that the petitioner is not interested in pursuing the matter and the same is dismissed in default and for non-prosecution. REKHA PALLI, J JANUARY 09, 2019 sr
