O R D E R
% 11.05.2026 By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners seek quashing of case FIR No. 0523/2023 dated 11.10.2023 registered under sections 308/323/341/34 of the Indian Penal Code, 1860 ('IPC') at P.S.: Sarita Vihar, South-East (Delhi).

The petition is premised on MOU/Settlement/Compromise Deed dated 17.04.2026, whereby the petitioners and respondents Nos. 2 to 5 have resolved the matter amicably.

The petition is also supported by affidavits of the petitioners and of respondents Nos. 2 to 5, alongwith proof of their IDs. 4.
The contesting parties are present in court. Their credentials have been verified and they have also been identified by their respective counsel.

Though the MLC has not been filed on record, learned APP has readout to the court the MLCs of the 04 injured persons. One of the injured persons had sustained grievous injury; whereas the other 03 had sustained simple injury. However, all 04 injured persons have now fully recovered.

The court has interacted with the respondents Nos. 2 to 5, as also with petitioners, who submit, that they are from the same village; and have now resolved the matter and a MOU/Settlement/Compromise Deed dated 17.04.2026 has been signed by them closing all issues amicably with no financial settlement. Parties now wish to live in peace and harmony going forward.

Mr. Shoaib Haider, learned APP confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties. 9.
However, considering the nature of violence committed by the petitioners on the injured persons, this court deems it appropriate that by way of atonement, the petitioners shall pay costs of Rs.50,000/- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Subject to the aforesaid condition, case FIR No. 0523/2023 dated 11.10.2023 registered under sections 308/323/341/34 of the IPC at P.S.: Sarita Vihar, South-East (Delhi) is quashed. All proceedings arising therefrom also stand closed.

The petitioners are directed to place on record the proof of payment of costs.

The Registry is directed to re-list the matter if costs are not paid as directed.

The petition stands disposed-of.
