% 11.05.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks parole for a period of 30 days in case FIR No.247/2003 registered under sections 376(2)(G)/366/394/34 of the Indian Penal Code, 1860 at P.S.: Chanakya Puri.

At the outset, Mr. Sanjay Lao, learned Standing Counsel (Criminal) appearing for the respondent/State submits, that they have received a copy of order dated 23.04.2026 from the Deputy Secretary (Home) Department whereby the petitioner's application dated 23.03.2026 seeking parole has been returned, observing that Rule 1213 of the Delhi Prisons Rules, 2018 provides that if a prisoner is eligible for W.P.(CRL) 1512/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. furlough then his release on furlough is to be considered first, before forwarding his application for parole.

In the circumstances, Mr. Lao submits, that in order to obviate further delay the petitioner's application dated 23.03.2026 seeking parole will be reconsidered as an application seeking furlough. The statement is taken on record.

Let the application be decided expeditiously under written intimation to the petitioner.
