IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 467/2018 JASPREET SINGH & ANR ..... Petitioners Through Mr. Bakshish Singh, Adv versus THE STATE (NCT OF DELHI) & ORS ..... Respondents Through Ms. Kusum Dhalla, APP WSI Manju Yadav, PS Janak Puri
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 13.04.2018 Respondent no.2 Ms. Shivani is present in the Court and has been identified by W/SI Manju of police station Janak Puri. She says that she has settled the matter with the petitioner no.2 of her own free will and without any undue force, pressure or coercion vide Compromise Deed dated 19th January, 2016 and she has no objection in case FIR No.1442/2015 under sections 509/506 IPC registered at police station Janak Puri and consequent proceedings emanating therefrom, are quashed qua the petitioner no.2 and her husband, petitioner no.1.
It is noted that FIR was initially registered under sections 509/506 IPC, however, during investigations sections 354A/381/34 IPC have been added and charge sheet has been filed under the aforesaid provisions. Compromise deed has been placed on record.
Keeping in view the settlement arrived at between the petitioner no.2 and respondent no.2 voluntarily, in my view no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, the aforesaid FIR and the consequent proceedings emanating therefrom are quashed qua both the petitioner nos. 1 and 2.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J APRIL 13, 2018 sm
