Learned counsel for the Petitioner refers to the order dated 16.04.2024 whereby the Court has restrained the Respondent from taking any coercive action against the Petitioner herein in furtherance of the impugned notice dated 24.03.2024 issued by the Respondent with respect to the FIR No. 11197054230939.

He states that the interim order was duly served on the concerned Investigating Officer (IO) and thereafter the concerned IO has not sought the examination of the Petitioner within the jurisdiction of Police Station (PS) West Patel Nagar, Delhi.

Though the matter was listed on 31.07.2024 and 25.10.2024, however, none has appeared on behalf of the Respondent. 5.

In view of the settled law and the statement of the Petitioner herein, the petition is allowed.

The impugned notice dated 24.03.2024 is quashed. However, it is directed that Petitioner shall remain available for any interrogation at the instance of the Respondent, at PS West Patel Nagar in accordance with law. 7.

With the aforesaid directions, the petition along with pending applications stand disposed of.
