IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 567/2018 LALIT ARORA ..... Petitioner Through :

Mr B.B.Sharma, Advocate.

versus THE STATE(NCT OF DELHI) & ORS ..... Respondent Through :

Ms Anita Abraham, Addl. PP for the State.

CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 13.04.2018 1.

Petitioner seeks quashing of FIR No.1443 /2015, under Section 354A IPC, Police Station Janak Puri, based on a Settlement. 2.

It is submitted that a cross FIR No.1442/2015 has been registered under Sections 354A/381/506/509/34 IPC, Police Station Janak Puri, which has been quashed by way of order in Crl.M.C.No.467/2018 of today's date.

3.

Parties have settled their dispute. A Compromise Deed dated 19.01.2016 has been executed between the parties. 4.

Parties are present in Court in person.

Respondent No. 2 is present in person and identified by the Investigating officer. She confirms that Settlement has taken place between the parties. She further submits that she does not wish to prosecute her complaint and Crl.M.C.567/2018

has no objection to the quashing of the subject FIR. 5.

In view of the above and keeping in view of the fact that the parties have resolved their dispute through a Compromise Deed dated 19.01.2016 and respondent No. 2 does not wish to press her complaint, and in view of the fact that the cross-FIR registered by wife of the petitioner against respondent No.2 has already been quashed, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6.

Accordingly, FIR No.1443/2015, under Section 354A IPC, Police Station Janak Puri, and the consequent proceedings emanating therefrom are hereby quashed.
