% 22.04.2024 At the outset, learned counsel for the petitioner submits that they have appointed Hon'ble Justice L. Nageshwara Rao, Former Judge, Supreme Court of India as their nominated arbitrator. The respondents have also nominated Hon'ble Justice Rinzin Penjor, Former Judge, Hon'ble Supreme Court of Bhutan.

Learned counsel submits that in these circumstances, the petitioner seeks permission to withdraw the present petition with liberty to file fresh petition in case both the nominated arbitrators are unable to nominate the third arbitrator.

In view of the above, the present petition along with pending application stands dismissed as withdrawn.
