The present Petition has been filed under Section 115 of the Code of Civil Procedure, 1908 (CPC) impugning the order dated 03.04.2023 [hereinafter referred to as "Impugned Order"] passed by the learned District Judge-03, Shahdara, Karkardooma Court, Delhi. By the Impugned Order, the Application filed by the Petitioner (Defendant before the learned Trial Court) under Order VII Rule 11 of the CPC has been dismissed. 2.
After some arguments, learned Counsel for the Petitioner seeks permission of the Court to withdraw the present Petition with liberty to agitate all contentions before the learned Trial Court. 3.
The Petition is dismissed as withdrawn. All pending Applications also stand closed. The liberty is granted to the Petitioner to agitate all contentions in accordance with law.
