During course of the consideration, learned counsel for the applicant, in all fairness, submitted that one material public witness is already under examination and the next date for recording of his deposition is 27.04.2026. 2.

After some arguments, he states that at this stage, he would not press his application but prosecution should ensure the presence of the abovesaid witness on the next date. He submits that he would also make best effort to cross-examine the abovesaid witness and would move application seeking bail afresh, once the evidence of the abovesaid witness is complete. 3.

In view of the above, the present application is disposed of as not pressed. Liberty, as prayed, is granted to the applicant. 4.

Simultaneously, I.O. shall render due assistance and co-operation in this regard to the learned Trial Court and shall ensure that the abovesaid material witness-Mohd. Sabir appears before the learned Trial Court on the said date and his examination is conducted as expeditiously as possible.
