This is an application jointly filed by the parties under Section 151 of CPC, 1908, seeking directions for disbursement of the amount of Rs. 3,95,26,024/-, along with the accrued interest as of date, deposited by NSSL Pvt. Ltd. with the Registrar General, Delhi High Court in terms of order dated 17.08.2021.

The parties have entered into a Settlement Agreement dated 01.09.2025, wherein it is agreed that the amount deposited by the NSSL Pvt. Ltd. with the Registrar General, Delhi High Court including the accrued interest as on date and till the date of payment, shall be apportioned in the ratio of 55:45 between the parties i.e., HPCL-Mittal Energy Ltd and NSSL Pvt. said amount shall be released directly to the respective bank accounts of the parties in the said agreed ratio.

In view of the said Settlement Agreement entered between the parties, this Court directs the Registrar General, Delhi High Court to disburse the amounts deposited by NSSL Pvt. Ltd. along with up-to-date accrued interest till the date of disbursal, as per the agreed ratio in the respective Bank Account of the parties as described in the present application and extracted below:- "a) 55% of the Total Accrued Amount (including accrued interest to that extent as of the date of disbursal of the said amounts) to Second Party- HPCL-Mittal Energy Ltd., to the following account: - Account Name: M/S HPCL-MITTAL ENERGY LTD Bank Name: State Bank of India Account No: 32551280719 IFSC Code: SBIN00 17313 Branch: Corporate Accounts Group Branch-II MICR Code: 110002562 b) 45% of the Total Accrued Amount (including accrued interest to that extent as of the date of disbursal of the said amounts) to First Party-NSSL Pvt Ltd. In view of the order passed above and Settlement Agreement entered between the parties, wherein NSSL Pvt. Ltd. has agreed to withdraw the present petition, the present petition is dismissed as withdrawn. OMP (ENF.) (COMM.) 93/2021 6.

In view of Settlement Agreement entered between the parties wherein HPCL-Mittal Energy Ltd. has agreed to withdraw its enforcement petition being O.M.P. (ENF.) (COMM.) 93/2021, the present petition is dismissed as withdraw.
