The petitioner seeks quashing of FIR No. 264 of 2013 under Sections 323/354/354A/509 of the IPC Police Station Swaroop Nagar, New Delhi.

It is contended that the alleged incident occurred on account of parking of vehicles. The parties are neighbours for the last over 30 years. It is contended that with the intervention of respectable members of the society and neighbourhood, the parties have settled their disputes.

Respondent no. 2 is present in person in Court today, represented by her counsel and is identified by the Investigating Officer. She submits that she has settled all the disputes with the intervention of locals and respectable people of the locality. She CRL.M.C. 446/2018

further submits that she does not wish to press the criminal complaints against the petitioner any further.

It is further submitted on behalf of the parties that a Memorandum of Understanding dated 10.01.2018 has also been executed between the parties.

In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace and harmony are restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petitions are allowed. FIR No. 264 of 2013 under Sections 323/354/354A/509 of the IPC Police Station Swaroop Nagar, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed. 7.
