The present application under Section 439 Cr.P.C has been filed by the Petitioner for grant of regular bail in FIR No.762/2023 dated 13.09.2023, registered at Police Station Pahar Ganj for offences punishable under Sections 313/376/201/506 IPC.

Learned Counsel for the Prosecutrix states that the Prosecutrix has been examined and discharged, however, he states that there is one more public witness to be examined which is likely to take place on 23.07.2024. 3.
Confronted with this, the learned Counsel appearing for the Petitioner seeks permission to withdraw the present application with liberty to approach the Competent Court for grant of bail after all pubic witnesses are examined.
