% 01.03.2017 By the present Transfer Petition under section 24 CPC the petitioner seeks transfer of the suit filed by the respondents being Suit No.111/2015 (actually being 111/2014) titled Al Nafees Frozen Food Exports Pvt. Ltd. vs.Shri Vipin Verma and Others pending in the court of Shri Siddharth Malik, Civil Judge, Delhi to this court to be tried alongwith CS(OS)2371/2015 titled Delhi Transport Corporation vs. Vina Jaswant Chaddha and Ors. and Suit No.CS(OS)1159/2015 filed by Shri Vipin Verma (respondent No.4 herein) pending before this court. Learned counsel for the respondent submits that he has no objection to the transfer. He, however, submits that CS(OS) 1159/2015 has already been disposed of. This fact is confirmed by learned counsel for the petitioner.

Accordingly, as parties are common and some of the facts/issues are common, the suit filed by the respondent being Suit No.111/2014 titled Al Nafees Frozen Food Exports Pvt. Ltd. vs. Shri Vipin Verma and Others pending in the court of Shri Siddharth Malik, Civil Judge, Delhi would stand transferred to this Court to be heard alongwith CS(OS) 2371/2015 titled Delhi Transport Corporation vs. Vimla Jaswant Chaddha & Ors. The matters shall be heard together. The said matter being Suit No.2371/2015 is said to be listed before Joint Registrar on 11.5.2017. The suit which is being transferred may also be listed before Joint Registrar on the said date. Petition and all pending applications, if any, stand disposed of.
