CM No.17009/2020 (Exemption from filing notarized affidavit and affixing of court fee) 1.

This application has been filed seeking exemption from filing duly notarised affidavits and affixing requisite court fee. Binding the deponent of the affidavit to the contents of the application, the exemption is granted. 2.

Court fee shall be deposited online with the concerned authority within one week and physical stamp be filed within 72 hours from the date of resumption of regular functioning of the Court, as mandated in terms of Office Order dated April 04, 2020 issued by this Court. 3.

Application is disposed of.

W.P.(C) 4698/2020 & CM No. 16912/2020 (Directions) 1.

This petition has been filed by the petitioner praying for a Writ of mandamus directing the respondents to allow the goods of the petitioner to be exported.

The learned counsel for the respondents, who appears on advance notice, submits that pursuant to an inspection of the container containing the goods of the petitioner being carried out by the respondents at Nhava Sheva Port, certain discrepancies were found in the quality and quantity of the goods sought to be exported by the petitioner. Pursuant thereto, Summons for appearance were issued to the petitioner, which remains un-served due to the petitioner not being found at the given address. 3.

The learned counsel for the respondents shall supply copies of these summons to the learned counsel for the petitioner during the course of the day.

The learned counsel for the petitioner submits that the petitioner shall appear before the respondent no.2 at 2.30 p.m. on 31.07.2020. 5.

In view of the above, the present petition is disposed of leaving all the contentions of the petitioner open before the respondent no.2. There shall be no order as to cost.
