This is an application filed by the plaintiffs under Section 152 of the Code of Civil Procedure, 1908 (8CPC9) seeking correction of the phrase <allowed= in paragraph 8129 of the judgment dated 23.04.2025. 2.
Learned counsel for the plaintiff states that since the intent of the judgment dated 23.04.2025 is to dispose of the suit and not reject the plaint, therefore, the phrase <allowed= may be replaced with the phrase <disposed of= in order to obviate any prejudice to the plaintiffs in the pending proceedings in TEST CAS. 53/2022.

Issue notice. Learned counsel for the defendant states that he has no objection to the relief.

The intent of this Court was to dispose of the suit, which is evident from the judgment dated 23.04.2025, therefore, it is reiterated that the plaint has not been rejected but the suit has been disposed of and therefore, paragraph 8129 is corrected and reads as under:- <12. With the aforesaid directions, the application stands disposed of and the suit stands disposed of.= 6.
The order dated 23.04.2025 will be read along with this order. 7.
