After making submissions for some time, the Counsel for Applicant states that since the trial has progressed, and only one prosecution witness remains to be examined, he would like to withdraw the present application and seeks leave to urge all the grounds before the Trial Court, at an appropriate stage. He, however, requests that the Trial Court be requested to expedite the trial.

In view thereof, the application is dismissed as withdrawn with liberty as aforesaid.

It is noted that the Applicant has been in custody for more than five years. In this background, the Trial Court is requested to conclude the trial as expeditiously as possible.

All rights and contentions of the parties are left open. 5.
