This hearing has been done through hybrid mode. 2.

The present writ petition under Article 226 read with Article 227 of the Constitution of India and 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks the following prayers: - "i. Issue directions to the Ld. Trial Court to complete Prosecution Evidence in FIR No. 530/2015 PS South Campus in SC no. 9211/2016 within a month and set a date for final arguments in a month; or/and, ii. Pass any such further or other Orders as this Hon'ble Court may deem fit in and proper in the facts and circumstances of the instant case and/or in the interest of justice."

Learned counsel appearing on behalf of the petitioner submits that the survivor in the present case was 6 years old at the time of the incident and since 2023 the matter is pending before the learned Trial Court for the examination of the Investigating Officer.

In compliance of the order dated 16.04.2025, a progress report dated 14.05.2025 has been received from the Office of the Principal District and Sessions Judge, New Delhi District, Patiala House Courts, New Delhi, wherein, it has been stated that the present case has been delayed due to medical condition of the accused. It is further recorded that as per the medical board of IHBAS, the accused has been diagnosed with mild Neurocognitive Disorder and currently he is unfit to stand trial. It is further recorded vide order dated 08.05.2025, a fresh report on the medical condition of the accused has been summoned from IHBAS and as to whether the mental illness of accused is temporary or permanent and same is curable or not. Even the learned Trial Court is awaiting the said report.

In view of the above, the present petition is disposed of with the request that learned Trial Court shall expedite the proceedings pending before it without giving undue adjournments.
