$~5 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(CRL) 1149/2020 PARIMAL SINGH & ORS.
..... Petitioners Through:
Mr Arvind Aggarwal, Advocate.
versus STATE OF G.N.C.T OF DELHI & ORS.
..... Respondents Through:
Mr Divyanshu Sharma, Advocate for Mr Avi Singh, ASC for State with SI Dheer Singh-PS Farsh Bazar.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 29.07.2020 [Hearing held through video conferencing] CRL.M.A. Nos. 10093 & 10094/2020 1.
Exemptions are allowed, subject to all just exceptions. 2.
The applications are disposed of.
W.P.(CRL) 1149/2020 and CRL.M.A. No. 10092/2020 3.
The petitioners have filed the present petition, inter alia, praying as under:- "Issue writ of certiorari or any other appropriate writ thereby quashing the FIR No.487/2019, U/s 406 IPC, registered at P.S. Farsh Bazar, Delhi and/or meanwhile stayed the arrest of petitioners Nos.2, 3, 4 and 6 and continued the bail granted to petitioner Nos.1 and 5."
4.
Mr Sharma, learned counsel appearing for the State points out that insofar as the petitioner's prayer for quashing of the FIR in question is concerned, a similar prayer was made in another writ petition [W.P.(CRL.)
570/2020] which was dismissed on 27.02.2020. He submits that this Court had specifically found that the said petition was bereft of any merit. 5.
The learned counsel for the petitioner does not dispute the above. In the circumstances, the petitioners' prayer for quashing the FIR in question cannot be acceded to.
6.
It is seen that further reliefs sought by the petitioner essentially amount to seeking bail/anticipatory bail. This Court does not consider it apposite to entertain a prayer for such reliefs in these proceedings. 7.
It is clarified that all rights and contentions of the petitioners on merits and their right to avail other remedies including bail and anticipatory bail, are reserved. Needless to state that as and when any such application is made, the same would be considered on its own merits. 8.
The petition is dismissed with the aforesaid observations. The pending application is also disposed of.
