This is fresh petition u/S. 27 of Arbitration and Conciliation Act. The respondent has not put up appearance despite advance notice. Ld. Counsel for petitioner has stated that there is urgency in the matter as the next date for evidence before Ld. Arbitral Tribunal is 26.04.2024. Keeping in view the facts and circumstances mentioned in the petition, the petition is allowed and concerned official of Registry is directed to issue notice / summons of the concerned officials of BSNL as per the address mentioned in the petition, for producing the requisite documents in evidence before the Ld. Arbitrator on 26.04.2024.

Summons be issued to the witnesses as mentioned in the petition on filing of PF within two days, in terms of Minutes of proceedings dated 04.04.2024 of the Ld. Arbitrator, the relevant portion of which is as under : "Let the Respondent move the Hon'ble High Court of Delhi under Section 27 of the A&C Act, 1996 for summoning the aforesaid documents through the concerned official of BSNL on 26.04.2024 at 5 PM. The witness shall attend the office of the Respondent's Advocate for production of the aforesaid documents. He may be asked to bring three photocopies of each of the document so that one may be deposited with the Tribunal and the other two may be handed over to both the parties. The witness is being summoned only for production of records."
