This is a petition under Section 439 of the Code of Criminal Procedure seeking regular bail in case FIR No. 357/2019 under section 307/34 IPC registered at P.S. Palam Village, Delhi. 2.
After some arguments, learned counsel for the petitioner submits that he is not pressing the petition for regular bail, but only seeks interim bail for 45 days in terms of the recommendations dated 18.05.2020 of the High Powered Committee appointed by this Court. 3.
As per the recommendations of the High Powered Committee, an undertrial prisoner facing trial in a case under Section 307 IPC, who has been in jail for more than 6 months with no involvement in any other case, is entitled to be released on interim bail for 45 days, Signed By:GARIMA MADAN Location:

subject to his conduct in jail being found to be satisfactory.
4. The petitioner has been charged under Section 307/34, IPC. His nominal roll has been received from the jail authorities, according to which, it is evident that as on date, the petitioner has been in jail for more than one year and his conduct in jail has been certified as being satisfactory. The petitioner is also not reported to be involved in any other criminal case.

In the light of the aforesaid facts, the learned APP is unable to dispute that the petitioner fulfils the criteria for being released on interim bail for 45 days, as laid down in the recommendations of the High Powered Committee dated 18.05.2020.

The petitioner is accordingly granted interim bail for a period of 45 days in accordance with the aforesaid recommendations, subject to his furnishing a personal bond in the sum of Rs.25,000/- to the satisfaction of the Jail Superintendent. Upon his release on interim bail, the petitioner will neither contact any of the prosecution witnesses, nor leave the NCR of Delhi. The petitioner will furnish a mobile phone number to the concerned Jail Superintendent as also to the I.O., PS Palam Village, Delhi, which number will be kept operational at all times so that he can be contacted by the police authorities, if the need so arises.
