At request of learned counsel appearing on behalf of the appellant, in order to enable him to obtain instructions, the matter is passed over. At 2:15 PM Subsequent upon the institution of the present appeal, which assails the order dated 28.07.2020 passed by the learned Single Judge in I.A. No. 3837/2020 and I.A. No.4434/2020 in C.S. (Comm) No. 122/2020 titled as 'Beoworld Private Limited vs. Bang & Olufsen Expansion A/S", on an application under Order VII Rule 10 of Code of Civil Procedure, 1908, instituted on behalf of the respondents herein, being I.A. No.4174/2020, the FAO(OS) (COMM) 90/2020 Page 1 of 2

plaint filed on behalf of the appellants herein has been returned by the learned Single Judge of this Court, vide order dated 24.08.2020. In view of the forgoing, learned counsel appearing on behalf of the appellants seeks leave to withdraw this appeal, as having been rendered infructuous at this stage, with liberty to institute an appropriate proceeding at an appropriate stage, in accordance with law. Leave and liberty granted.
